USER AGREEMENT

MEXIBLUE INNOVATIONS owns and manages "Boundryedge," a game that may be found on the Website/Mobile App that contains a link to these Terms of Use. In accordance with these Terms of Use (the "Terms of Use," or "Terms"), our privacy policies, and other guidelines, we are happy to grant you access to our mobile app Boundryedge and our website https://boundryedge.com/ and the opportunity to take part in our fantasy sports contests of skill by submitting a participation fee in cash games or merely registering for participation in no-free games.

CONSIDERATION

By using the Website or Mobile App, signing up for Services made available there, or accepting, uploading, submitting, or downloading any data or content from or to the Mobile app ("User"), you consent to these Terms of Use. These Terms of Use are a legal agreement between you and Boundryedge and shall continue to apply to your use of the Website/Mobile App and the Services even after termination. IF YOU DO NOT AGREE TO BE BOUND BY ALL OF THESE TERMS OF USE, DO NOT USE THE WEBSITE/MOBILE APP/MOBILE APP.

MOBILE APPLICATION

Boundryedge Mobile Application is subject to these Terms of Use as well. In the event that any of these Terms of Use conflict with the End User License Agreement, these Terms of Use shall be deemed to apply and the conflicting provision in the End User License Agreement shall not be applicable. These Terms of Use are intended to be in addition to the End User License Agreement of the applicable application provider, such as Google Play, Apple Store, Windows Store, or any similar store for the Mobile Application. In these Terms of Use, any mention of the Website or Mobile App shall also be deemed to refer to the Mobile Application.

ELIGIBILITY

To create a "Boundryedge account" on the website or mobile application, take part in skill-based competitions, or win rewards, users must be at least 18 years old. You must be at least the legal age in your local jurisdiction or territory to use the Website or Mobile App in any countries, territories, or locations where the minimum age for use of the Website or Mobile App is greater than 18. Legal residents of Assam, Odisha, Telangana, Andhra Pradesh, Nagaland, Sikkim and Arunachal Pradesh (the "Excluded States") who are physically located outside of India are not eligible to participate in paid contests offered by the Website/Mobile App and are also not eligible to win prizes offered by the Website/Mobile App. For use solely in games without prizes, residents of the Excluded States may create and maintain accounts on the website or mobile application. Additional states may be added to the Excluded States at the sole discretion of the Website/Mobile App or the judicial or government body through an order, decree, decision, or directive. Players from these states will not be permitted to take part in skill games with prizes in this situation. Any consideration, money, or credit that the player has on file with Boundryedge must be placed in a suspense bank account (which must be interest-free) until the relevant governmental or judicial body expressly approves its remittance to the relevant territory India.

Only one Boundryedge account can be created by a user per person in order to use the website or mobile app's services. In addition to any other legal options available to Boundryedge, Boundryedge reserves the right to suspend or terminate any or all of your accounts as well as cancel, withhold, or rescind the granting of any rewards if it comes to light that you have opened more than one Boundryedge account per person. You assume responsibility for all activities, charges, and damages that take place under your account, and you are responsible for keeping your login information secure. Allowing any other person to use your account to enter a contest is a violation of these terms of use. You should get in touch with us right away if you have any cause to suspect that someone is using your account without your consent. If you fail to let us know about any unauthorized usage, we will not be held accountable for any loss or damage that results. You must give us accurate and complete information if we ask for registration-related information from you, and you must keep us updated on any changes.

"Authorized Account Holder'' is defined as a natural person who is 18 years of age or older and who has been given a valid mobile phone number from a licensed telecommunications service provider in India OR an email address or a Facebook identity by a company (such as a business, educational institution, etc.) that is in charge of assigning email addresses/Google IDs/Facebook IDs for the domain. Authorized account holders confirm their legal ownership of the payment method account used to make any deposits on the website or mobile app's Boundryedge account by entering a payment method to take part in real money competitions. Any Authorized Account Holder who submits payment using a payment method that is not owned by the Authorized Account Holder is in violation of these Terms of Use.

Any winnings obtained from Boundryedge contests will be voided, forfeited, and withdrawn from your Boundryedge account balance if any deposit is charged back. The initial deposit sum will also be nullified, forfeited, and subtracted from the Account balance. Should a deposit be charged back, Boundryedge reserves the right to close your account - without prior notification.

Boundryedge has the right to suspend a User's Boundryedge account if it is discovered to have been inactive or to have an unutilized balance for 335 days or more.

Employees of Boundryedge may use the Website/Mobile App at times to evaluate the user experience, engage in community-building activities with customers, and for other appropriate business continuity purposes as determined by Boundryedge.

CONTEST ENTRY

Users will be able to observe the games that are open for entry (the "Contests" or "Tournaments") by visiting the Website/Mobile App. The entry cost for any contest that requires payment is indicated in Indian National Rupees (INR). The specified amount of INR will be deducted from your Boundryedge account when you choose to enter a Contest and finish the entry process.

It is now made clear that Boundryedge wants to provide both guaranteed leagues contests and non-guaranteed leagues contests in order to make the provision of services to Users easier. Under the condition that these terms and conditions are followed, Boundryedge guarantees the conduct of the Contests in the promised leagues. If the necessary Users or any other listed requirements are not met for the non-guaranteed leagues Contests, Boundryedge shall have the right to cancel the Contest and restore the consideration to the Boundryedge account.

There will be no bonus facility in the private league. Users may only spend their remaining funds and winnings; they are not permitted to participate in private leagues using bonus funds.

REFUND POLICY

Every purchase is final. There will be no reimbursements given. If there is a disagreement about who submitted an entry, it will be assumed that the person whose name the account was registered on submitted it. Only the payment settlement system provider that the Authorized Account Holder used to make a deposit into the Boundryedge account may receive a reimbursement. After processing the refund request and confirming the refund, the website/mobile app will make every effort to process the refund within 14 business days.

CONDITIONS OF PARTICIPATION

By participating in a Contest, participants consent to be bound by these Rules and Boundryedge's decisions, which are final and binding in all respects. If an applicant engages in behavior or otherwise uses information that Boundryedge deems improper, unfair, or otherwise detrimental to the operation of the Contest or is in any way harmful to other applicants, Boundryedge may, in its sole discretion, disqualify the applicant from the Contest, refuse to award benefits or prizes, and require the return of any prizes. Entrants, including but not limited to the winner(s), agree to defend, indemnify, and hold harmless Boundryedge and Boundryedge, as well as Boundryedge's parents, subsidiaries, affiliates, and agents, as well as the officers, directors, employees, shareholders, and representatives of any of the foregoing entities (collectively, the "Released Parties") from any and all liability, claims, or actions of any kind at all, including but not limited to: To be eligible for any prize or payout, an Authorized Account Holder must sign a different release of claims identical to the one mentioned above in this paragraph, at the sole and absolute discretion of Boundryedge.

Boundryedge is not responsible for: any incorrect, invalid or inaccurate entry information; human errors; postal delays/postage due mail; technical malfunctions; failures, including public utility or telephone outages; omissions, interruptions, deletions or defects of any telephone system or network, computer online systems, data, computer equipment, servers, providers, or software (including, but not limited to software and operating systems that do not permit an entrant to participate in a Contest), including without limitation any injury or damage to any entrant's or any other person's computer or video equipment relating to or resulting from participation in a Contest; inability to access the Website/Mobile App, or any web pages that are part of or related to the Website/Mobile App; theft, tampering, destruction, or unauthorized access to, or alteration of, entries and/or images of any kind; data that is processed late or incorrectly or is incomplete or lost due to telephone, postal issues, computer or electronic malfunction or traffic congestion on telephone lines or transmission systems, or the Internet, or any service provider's facilities, or any phone site or Website/Mobile App or for any other reason whatsoever; typographical, printing or other errors, or any combination thereof.

Entries that are incomplete, illegible, misdirected, or stolen are not the responsibility of Boundryedge. If a contest cannot be run as intended for any reason, or if a contest, computer application, website, or mobile app connected to it (or any part thereof) is corrupted or does not permit the correct entry to a contest in accordance with the Terms of Use or applicable Contest rules, or if an infection by a computer (or similar) virus, bug, tampering, unauthorized intervention, entries made by third parties, fraud, technical issues, or any other causes results in the contest being declared Notification will be issued on the website/mobile app if such cancellation, termination, change, or suspension takes place.

Boundryedge RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW FOR ANY ATTEMPT MADE BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF ANY CONTEST.

No entries will be acknowledged or returned; all submissions become the property of Boundryedge.

The Authorized Account Holder may be required to provide Boundryedge or Boundryedge (as the case may be) with additional documentation and/or information to verify the Authorized Account Holder's identity and to provide proof that all eligibility requirements have been satisfied in order to be eligible to enter any contest or win any prize. In the event that an Authorized Account Holder's identity or eligibility are in question,or Boundryedge may, in their sole and unfettered discretion, use certain information they have collected to help verify the identity and/or eligibility of such Authorized Account Holder.

Each Contest's participation requirements must be followed exactly as laid out in the Terms of Use. If you do not follow these rules, you will be disqualified and, if necessary, your award will be forfeited.

Participants and winners agree that their names, voices, and likenesses or photographs may be used in connection with the creation, production, distribution, and/or commercial exploitation of any Contest or the Website/Mobile App, to the extent permitted by law. Winners consent to making themselves available to Boundryedge or Boundryedge for publicity, advertising, and promotion activities starting on the date that Boundryedge or Boundryedge notifies them that they are a potential winner and continuing until Boundryedge or Boundryedge notifies them that they are no longer required to do so.

In specific circumstances established by Boundryedge or Boundryedge in its sole discretion, Boundryedge has the right to transfer contestants from the contests they have entered to contests that are substantially similar.

That Boundryedge or Boundryedge shall have the sole discretion to cancel the entire contest or a portion of it and refund the consideration to the authorized account holder only if the prize related to the contest has not already been determined and paid to the alleged winner. This clause applies in the event that a contest or a portion of it is found to be invalid or performances on which the contest is operated are disqualified.

CONTEST PRIZES AND PROMOTIONS

Only if a contest is conducted will prizes be given out. We reserve the right to end Contests whenever we want. Except as expressly stated in these Terms of Use, all entry costs will be reimbursed to the client in the event of a cancellation.

CONTEST RESULTS

The final statistics and scoring data from the last professional sports game of each individual Contest within two hours of its conclusion serve as the basis for the contest results and prize computations. Prizes are given out following the evaluation and grading of Contest outcomes. The score feed and other data needed for the computation and tabulation of the Contest points may be obtained by Boundryedge from a third party service provider. In the unlikely event that Boundryedge is made aware of any errors in the computation or tabulation of the Contest points, selection of the winner, etc. due to inaccurate or insufficient feed provided by a third-party service provider, it shall use its best efforts to correct such errors prior to the distribution of the prizes. By making this statement, Boundryedge makes it clear that it relies on the completeness and correctness of these third-party score/statistic feeds and does not intend to represent or guarantee the accuracy of such third-party information. Except at the discretion of Boundryedge/Boundryedge, the scoring outcomes of a Contest will not be altered regardless of any official statistics, scoring adjustments, or disqualifications made by the leagues at a later time or date.

PAYMENT AND PRIZE WITHDRAWAL

It is hereby made clear that all awards or withdrawals will only be made once Boundryedge's administrative and maintenance fees, any fees owed to the appropriate payment service provider, and any necessary taxes or duties have been deducted.

An affidavit of eligibility must be completed and signed by the participant before any payment is made, and among other things, it must state that the participant is eligible to participate in the Contest and is otherwise in compliance with this Agreement. If Boundryedge so requests, the participant may also be asked to provide proof of eligibility and compliance, such as a copy of their PAN card, Aadhar card, or voter ID. In such a case, Boundryedge may distribute any rewards that have been withheld or revoked in accordance with the Contest Rules to the other participants in the applicable contest.

An affidavit of eligibility must be completed and signed by the participant before any payment is made by Boundryedge. In it, the participant must, among other things, represent and warrant that they are eligible to participate in the Contest, are in compliance with all other terms of this Agreement, and, possibly, are required to provide supporting documentation, such as a copy of their PAN card, Aadhar card, or voter ID. In this case, Boundryedge may distribute any rewards that have been withheld or revoked in accordance with the Contest Rules to the other participants in the relevant contest.

By using the "Withdrawal" option on the Website/Mobile App, Participants may withdraw their cash prize awards as well as cash deposits. However, Boundryedge only awards bonuses that can be utilized to play in cash games; they cannot be withdrawn. In order to complete the withdrawal of prizes, entrants may be required to sign an affidavit of eligibility and a liability release (unless prohibited by law), as well as the appropriate tax forms, a photocopy of their PAN card, and any other forms of identification that Boundryedge may reasonably request, such as a driver's license or proof of residence. If you don't follow this rule, you risk being disqualified and losing any awards you might have won. Any participant who is found to have violated these Conditions of Use in any way may be disqualified or have their winnings forfeited.

Boundryedge will make an effort to handle withdrawal requests within 14 business days, and will only transfer payment to the same banks, e-wallets, or payment system providers used for the initial deposit. Demand drafts and/or checks are not permitted to be posted. Promotional deposits, credits, and other benefits cannot be withdrawn from a Boundryedge account until the user has fulfilled the necessary requirements of the offer.

The winner is solely responsible for paying any taxes related to receiving a reward. If Boundryedge needs to pay any taxes before awarding the prize or deduct any other taxes related to the reward, it must do so before awarding the money to the authorized account holder. If any legal authority challenges the awarding of prizes to contest winners, Boundryedge reserves the right, in its sole discretion, to decide whether or not to issue such rewards.

There can be no prize substitutions or transfers, but Boundryedge maintains the right to substitute a reward of equal or better value if the advertised prize isn't available. All awards are made "as is" and without any implied or express warranties of any sort (including, without limitation, any implied warranty of merchantability for a particular purpose).

Upon Boundryedge's approval, all withdrawal requests will be reimbursed back to the original mode of payment used to make deposits on the website/mobile app. Only if Boundryedge is satisfied, in its sole discretion, that the transaction is a legal transaction, would Boundryedge release withdrawals to a different payment method than the one that was used to make the deposit(s).

TERMINATION AND EFFECT OF TERMINATION

Some or all of your rights granted hereunder may be instantly revoked by Boundryedge without prior notice in addition to any other legal or equitable remedy. You will stop using the Boundryedge website and mobile app right away if this happens. Any passwords and/or account identifications that have been given to you may be revoked by Boundryedge, which may also prevent you from using the Website and/or Mobile App. Any such action won't have an impact on rights or duties that existed before it. Any Conditions of Use terms, such as those relating to ownership, warranty disclaimers, indemnity, and liability limitations, which by their nature should endure termination, shall do so.

DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, Boundryedge AND ITS SUBSIDIARIES, ASSOCIATES AND AFFILIATES MAKE NO REPRESENTATION OR WARRANTIES OR ENDORSEMENTS OF ANY KIND WHATSOEVER (EXPRESS OR IMPLIED) ABOUT: (A) THE WEBSITE/MOBILE APP; (B) THE CONTENT AND FUNCTIONS MADE AVAILABLE ON OR

You understand that by using any of the features of the website or mobile app, you do so at your own risk and that you represent and warrant that your activities are legal wherever you access or use the website or mobile app or the content. Boundryedge DOES NOT WARRANT THAT YOUR ACTIVITIES OR USE OF THE WEBSITE/MOBILE APP IS LAWFUL IN ANY PARTICULAR JURISDICTION AND, IN ANY EVENT, Boundryedge SPECIFICALLY DISCLAIMS

SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES SO THE ABOVE DISCLAIMER MAY NOT APPLY TO THE EXTENT SUCH JURISDICTION'S LAW IS APPLICABLE TO THIS AGREEMENT.

INDUS PLAY ONLINE DOES NOT TAKE ANY RESPONSIBILITY FOR THE DELAY IN FEED AND THEREFORE THE WRONG SELECTION OF THE PLAYER. PLEASE ALSO BE AWARE THAT, FOR OPERATIONAL REASONS, ALL WINNINGS FOR IN-PLAY MAY TAKE SLIGHTLY LONGER TO PROCESS AND REFLECT IN PLAYER ACCOUNTS.

LIMITATION OF LIABILITY

You understand and agree that Boundryedge limits its liability in connection with your use of the website/mobile app as set forth below: under no circumstances shall Boundryedge, its subsidiaries, associates or affiliates, or the directors, officers, employees, or other representatives some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. In no event shall the total liability of Boundryedge entities and individuals to you and all the authorized account holders collectively for all loss or injury.

INTELLECTUAL PROPERTY RIGHTS

The text, software, scripts, images, photographs, sounds, music, videos, interactive elements, and the like found on the website and mobile app, as well as the Boundryedge trademarks, service marks, and logos contained therein (the "Intellectual Property"), are all owned by or under license to Boundryedge. Nonetheless, Boundryedge explicitly denies having any official status with respect to any of the sports leagues or the organizations that make up such leagues. You are only permitted to use the content on the website/mobile app for informational purposes and for personal use; it cannot be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited without the prior written consent of the respective owners. The Website/Mobile App, Intellectual Property, and all other rights are reserved by Boundryedge. Unless as specifically allowed in this agreement, you undertake not to use, copy, or distribute any of the intellectual property. You must keep all copyright and other proprietary notices present when downloading or printing a copy of the Intellectual Property for your own use. The Website/Mobile App's security features, those that prohibit or restrict use or copying of any Intellectual Property, or features that enforce usage restrictions on the Website/Mobile App or the Intellectual Property therein may not be bypassed, disabled, or otherwise interfered with.

You might be able to upload or send audio, video, text, or other content (collectively, "User Submissions") to or via some Services, including information from a user account belonging to a third party, such as a Facebook account. You give Boundryedge, its parents, subsidiaries, associates, affiliates, and partners a non-exclusive, worldwide, royalty-free, fully sublicensable license to use, distribute, edit, display, archive, publish, sublicense, perform, reproduce, make available, transmit, broadcast, sell, translate, and create derivative works of any User Submissions you submit, as well as your name, voice, likeness, and other identifying information, if it is a part of a User Submission. You renounce all moral claims you may have regarding your user contributions here.

Additionally, you acknowledge that any User Contributions you provide must not include any content that Boundryedge deems to be inappropriate, obscene, vulgar, illegal, or otherwise objectionable (hereinafter, "Prohibited Content"). In addition to any and all other rights and remedies available to Boundryedge, posting any Prohibited Material may result in account suspension or termination.

We acknowledge that User Contributions are your property. Subject to any rights granted in the Conditions of Use and any access granted to others, you will still own any User Submissions that you had previously provided to us. Our general license to any User Submission that you remove from the Services expires after the reasonable amount of time necessary for the removal to be fully effective. The User Contribution might still be present in our backup copies, which are private. In the event that your User Submission is shared with third parties, it's possible that those parties have copies of your User Submission on file. Furthermore, even after you delete the User Contribution, we will still be permitted to create, replicate, redistribute, and sublicense any prior uses of it that we may have already made. Your User Contributions won't be immediately deleted if you close your account with a Service.

Without informing you, we reserve the right to reject or remove a User Submission. However, you acknowledge that we are under no duty to review User Submissions and that neither we nor our parents, subsidiaries, affiliates, employees, or agents shall be responsible for any loss or harm arising from User Submissions.

Even if the User Contribution is in a password-protected area, we do not promise that it will be secret, unless otherwise stated in the Privacy Policy. Thus, you shouldn't submit any User Contributions that you want to be private.

You affirm and warrant that you have all necessary authorizations to grant the aforementioned license to Boundryedge and that none of your User Submissions are defamatory, infringe upon the rights of others (including their intellectual property, privacy, or publicity rights), or otherwise violate the law.

CONSENT TO JURISDICTION

Indian courts shall have exclusive jurisdiction over all disagreements, claims, or controversies ("Claims") arising out of or connected with this Agreement, its violation, or the use of the Website (including all business transactions carried out through the Website).

MISCELLANEOUS

The laws of India shall govern these Conditions of Use.

Except as expressly specified herein, nothing in the Conditions of Use shall create or confer any rights or other advantages onto any third party. By taking part in any Contest on the website or mobile app, you consent to hold Boundryedge Entities and Individuals harmless from and against any and all third-party claims, liabilities, losses, damages, injuries, demands, actions, causes of action, suits, proceedings, judgments, and expenses, including reasonable attorneys' fees, court costs, and other legal expenses, including without limitation those incurred at the trial and appellate levels of court. Links to other websites and mobile applications that are not under the control of Boundryedge may be found on the website and mobile application. The content, privacy policies, or practices of any third party Websites or Mobile Apps are outside the control of Boundryedge, who also disclaims any liability in connection therewith. Furthermore, Boundryedge is unable and unwilling to filter or modify any third-party website's content. You expressly absolve Boundryedge from any and all liabilities resulting from your use of any third-party Website/Mobile App by utilizing the Website/Mobile App. As a result, we advise you to be cautious whenever you leave the Website or Mobile App and to carefully review the terms of service and privacy policies of every other Website or Mobile App you access.

Nothing in the Conditions of Use shall or be construed as creating, between you and Boundryedge, a partnership, agency, trust arrangement, fiduciary relationship, or joint venture.

There is no connection between Boundryedge and the Contests in any manner, shape, or form, nor is there any association between any professional or amateur sports league or any team affiliated with such a league.

The Boundryedge Website/Mobile App and any of the material, software, or functions made available on, or accessed via, or sent from, the Website/Mobile App are not controlled, endorsed, or administered by, or in any way affiliated with, any third-party web publishers.

The validity of the remaining provisions of these Conditions of Use, which shall remain in full force and effect, shall not be affected if any term of these Terms of Use is found to be illegal by a court of competent jurisdiction.

No waiver of any provision of these Conditions of Use shall constitute a subsequent or continuing waiver of such provision or of any other provision. Boundryedge? Failure by Boundryedge to exercise or enforce any right or provision in these Terms of Use does not signify a waiver of those rights or provisions.

You are responsible for checking these Conditions of Use periodically for updates since Boundryedge retains the right to make modifications at any time and without prior notice. You agree to all modifications if you use the Services after we make changes to the Terms of Use. The failure of Boundryedge to comply with any provision of these Terms of Use due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Boundryedge, or other force majeure event will not be regarded as a breach of these Terms of Use. This does not apply to compliance with applicable codes and regulations.
